“Is Religious Leader’s Certificate Necessary for Live-in Registration? UCC Committee Clarifies”

Uttarakhand: The Uniform Civil Code (UCC) has now been implemented in the state. Meanwhile, some media reports raised concerns about whether people in live-in relationships would need a certificate from religious leaders for registration. Manu Gaud, a member of the UCC Rules Committee, clarified that such a requirement would only apply to relationships where marriage is prohibited, as clearly mentioned in Schedule 01 of the code. Documents Required for Live-In Registration Under the UCC, when registering a live-in relationship, only basic documents such as proof of residence, date of birth, Aadhaar, and rental-related documents will be needed. Additionally, individuals who have previously been divorced must provide a legal order that their marriage has ended. Those whose partner has passed away or whose previous live-in relationship has ended will also need to submit relevant documents during registration. Manu Gaud further explained that religious certificates for proving the relationship would only be required in cases where the live-in couple had a prior relationship that falls under the prohibited category in Schedule 01. He pointed out that such cases would be rare in Uttarakhand, and only a small percentage of live-in relationship registrations would require such certification under the UCC.

Purpose of Religious Certificates Gaud emphasized that the requirement for religious leaders’ certificates would be applicable only to those who belong to communities where marriage is prohibited. In these cases, presenting a certificate from religious leaders would allow for the registration of their live-in relationships. The goal is not to block registration, but rather to assist in it. UCC Registration Not Tied to Permanent Residence Manu Gaud clarified that under the UCC, any person who has lived in Uttarakhand for a year can register, regardless of whether they are a permanent resident. This means that people from other states, who are currently benefiting from government schemes in Uttarakhand, will now need to register to continue receiving these benefits. This will also ease the pressure on the state’s resources, as it ensures that only those who are actually residing in Uttarakhand are benefiting from these services. Clear Guidelines for Registration Gaud further mentioned that the definition of residency under the UCC applies only to UCC-related matters and has five specific categories. The aim is to provide registration benefits to all people living in Uttarakhand while enriching the government’s database. He compared it to a voter ID, emphasizing that it is not tied to one’s permanent residence. He also explained that although the UCC registration form is 16 pages long due to the various options it offers, filling it out online would only take around five to ten minutes. The form can also be completed offline in a maximum of 30 minutes. Once the Aadhaar number is entered on the online portal, all the details will automatically fill in, making online registration more convenient.
