UCC in Uttarakhand: Experts Clear Doubts on Who Will Be Affected

Uttarakhand has become the first state in India to implement the Uniform Civil Code (UCC). This has sparked many questions in people’s minds regarding how it will be applied. One of the major concerns among residents is whether the UCC will apply only to native Uttarakhandis or if all people living in the state will come under its jurisdiction. Experts have now clarified these doubts.

Who Will Be Covered Under UCC in Uttarakhand?

Prof. Surekha Dangwal, a member of the expert committee that drafted the UCC and the Vice Chancellor of Doon University, has clarified that UCC registration has nothing to do with being a permanent resident or holding a domicile certificate of Uttarakhand. The law will apply to all individuals who have been residing in the state for at least one year. This provision has been made to protect Uttarakhand’s demographic structure.

Experts Issue Statement on UCC Provisions

Clarifying the provisions of UCC, Prof. Surekha Dangwal stated that the Uniform Civil Code deals with matters related to marriage, divorce, live-in relationships, and inheritance. It has no connection with permanent or native residency. Additionally, UCC registration does not provide any extra benefits, and the criteria for permanent residency in Uttarakhand will remain unchanged.

Curbing Criminal Activities

Prof. Dangwal explained that UCC registration is similar to how a person can obtain a voter card in any location where they reside. The goal is to regulate personal laws to preserve Uttarakhand’s culture and societal structure. It will also help control criminal activities in the state.

Registration Mandatory for Availing Government Schemes

She further stated that a large number of people from other states live in Uttarakhand and benefit from government schemes. Moving forward, these individuals will need to register under UCC to continue availing of these schemes. If UCC were applied only to permanent residents, many outsiders would be exempt from its provisions despite benefiting from state resources.

Strengthening Government Database

Another key objective of UCC registration is to create a stronger and more comprehensive government database. Currently, Uttarakhand lacks official records of marriages, divorces, and live-in relationships involving non-permanent residents. By bringing everyone under UCC registration, the state aims to improve its records while also reinforcing the institution of marriage, which has been the foundation of societal stability and growth.
