Big setback in Gwalior Municipal Corporation: High Court ordered to return all the officers on deputation

Big decision of Gwalior High Court: Ban on deputation in Municipal Corporation!- Gwalior High Court has recently given a big decision, which is going to bring a big change in the functioning of Gwalior Municipal Corporation. Hearing the PIL, the court has ordered to send back more than 60 officers and employees posted on deputation in the corporation to their original departments. The court found that the rules have been completely ignored in these appointments.

 Court’s displeasure over ignoring the rules- The court has raised questions not only on the employees posted on deputation, but also on the appointment of Corporation Commissioner Sangh Priya. The court said that the appointment of the commissioner should be done under Section 54 of the Municipal Corporation Act, which has not been done yet. The government has been directed to issue a new order under Section 54 within 15 days, otherwise the current appointment of Sangh Priya will be considered illegal.

All four additional commissioners and other officers also affected- This decision has also affected the four additional commissioners, deputy commissioners and assistant commissioners of the Municipal Corporation. The long-standing deputation system has now been declared illegal. This will have a direct impact on the functioning of the corporation. However, the court has admitted that problems may arise due to the sudden vacancy of all the posts, but it is necessary to follow the rules.

Temporary exemption on some posts, but with a condition- The court has given the Municipal Corporation the exemption to temporarily retain employees on some important posts, but for this the Municipal Commissioner will have to give the names, posts and other information of all the employees to the court. This exemption is only for third class posts so that the work is not disrupted.

 Direct recruitment necessary for all posts in 8 months- The High Court has ordered that the Municipal Corporation will have to fill all the vacant posts through direct recruitment within 8 months. This will increase administrative transparency and provide opportunities to qualified candidates. With this decision of the court, the practice of deputation of officers by bypassing the rules is now expected to end.
