Government is cautious about promotion rules in MP, caveat lodged in court

Government Anticipates Legal Challenges-The Madhya Pradesh government has preemptively filed a caveat in the High Court, anticipating lawsuits from employee organizations over the recently implemented 2025 Public Service Promotion Rules. This strategic move ensures the government’s voice is heard before any court orders are issued.

Caveat Filed Across Multiple Benches-The General Administration Department has filed caveats in the principal bench of the Jabalpur High Court, as well as its Gwalior and Indore benches. This ensures that regardless of where a challenge is filed, the government will be notified.

 Promotion Process Underway-With the new rules in effect, the state has begun the promotion process. The General Administration Department has taken the lead, establishing guidelines for forming Departmental Promotion Committees (DPCs) to ensure a consistent approach across all departments.

 Reservation Provisions in New Rules-The 2025 rules explicitly include reservation provisions for Scheduled Castes (SCs) and Scheduled Tribes (STs) in promotions. Mirroring direct recruitment, SCs will receive 16% reservation and STs 20%, with a mandatory inclusion of a reserved category officer in each DPC.

 Employee Union Threatens Legal Action-The SPaX union has voiced strong opposition to the new rules, threatening legal action, arguing that the rules prioritize reservation over merit. This threat prompted the government’s preemptive caveat filing in the High Court.
